<title>Aussie Game Censors Under Fire</title>

THE AUSSIE SYSTEM for rating games is under fire after censors banned one of the year's most anticipated releases, Fallout 3. <br />
<br />
The Classification Board refused to issue it an age rating, claiming that the game promoted drug use. What got the censor's miffed was that players can use drugs to boost their characters' abilities such as stamina, health and intelligence.<br />
<br />
Since there is no R18+ classification for games in Oz, those games that don't meet the MA15+ standard are banned from sale.<br />
<br />
Gameplayer.com.au points out that there are shedloads of games out there which have a similar or higher level of drug use including Battlefield Bad Company, BioShock, Haze and Grand Theft Auto IV. However the censors have waved these games through.<br />
<br />
The Classification Board said computer games may include depictions of drug use but could not provide incentives or rewards to players for doing so.<br />
<br />
It was really miffed that using morphine in the game had the positive effect of enabling the character to ignore limb pain.<br />
<br />
As hack Ben Mansill, who is the associate publisher at Gameplayer.com.au, points out that morphine was not a street drug but a painkiller portrayed in countless09:09 films and on the telly as a way of easing pain.<br />
<br />
It creates a weird message that killing people is acceptable in games, but applying first aid to yourself when hurt was not, he said.]]></description>

<description><![CDATA[A gaming service that aims to kill off the traditional gaming console will begin streaming popular games over the internet in June this year.<br />

OnLive, which launched to much fanfare in 2009, announced details of its service at the GamesBeat conference. Instead of games taking hours to download or buying them off the shelf, OnLive promises games on-demand.<br />
<br />
"OnLive breaks the console cycle. We don't need new hardware devices," said company founder Steve Perlman. That sentiment was echoed by his chief operating officer Mike McGarvey.<br />
<br />
"We want to take your dollars from hardware and let you spend it on software. We are a new platform and we're building a network and infrastructure to last for the next 30 years of gaming, not the next five years," Mr McGarvey told reporters.<br />
<br />
OnLive will be available for a monthly rental fee of $14.95 (�9.99) for subscribers to then buy or rent games over the internet.]]></description>

<title>Duke Nukem Forever Gone Forever?</title>

<description><![CDATA[Veteran games developer 3D Realms has closed down because of a lack of funds.<br />

Founded in 1987, the firm popularised the concept of shareware gaming and produced the seminal Duke Nukem and Wolfenstein 3D first-person shooters.<br />
The company was working on a follow-up title, Duke Nukem Forever, which after being in development for 12 years has become the object of industry derision.<br />
Publisher Take-Two says it will no longer fund development of the game but retains rights to the title.<br />
<br />
"We can confirm that our relationship with 3D Realms for Duke Nukem Forever was a publishing arrangement, which did not include ongoing funds for development of the title," said Take-Two's Alan Lewis in a statement.<br />
<br />
There has been no official comment from 3D Realms, other than a forum posting from the company's webmaster, Joe Siegler, who said: "It's not a marketing thing. It's true. I have nothing further to say at this time."<br />
<br />
Other companies with links to 3D Realms or the Duke Nukem series were quick to distance themselves. <br />
<br />
In a posting on Twitter, Apogee Software said it was "officially not affected by the situation at 3DRealms". <br />
<br />
"Development of the Duke Nukem Trilogy is continuing as planned and further announcements about upcoming games will be made in the near future," the statement added. <br />
<br />
Guardian newspaper games writer Steve Boxer said it was astonishing 3D Realms had not finished the game after more than a decade of development. <br />
<br />
"It would have been nice to see another Duke Nukem game, but given they had more than 12 years it's just incompetence of the highest order. <br />
<br />
"3D Realms made some great games in the past, but they got overtaken by the 21st Century. <br />
<br />
"Sadly, Duke Nukem Forever was the most aptly named title in the history of games. Now, it's just Duke Nukem Never."]]></description>

<title>Activision countersues 'Modern Warfare' execs</title>

Activision filed a countersuit against two of its senior executives responsible for the "Call of Duty: Modern Warfare 2" game, claiming that they undermined the company by threatening to poach employees and delaying development of sequels.<br />
<br />
Jason West and Vince Zampella, executives in Activision's Infinity Ward unit, filed suit against Activision last month, seeking more than $36 million, after they were fired for insubordination. They claimed that the company's motive was to avoid paying them royalties for their work on the franchise.<br />
<br />
Their former employer, in a suit filed on Thursday in Los Angeles Superior Court, says the duo "morphed from valued, responsible executives into insubordinate and self-serving schemers who attempted to hijack Activision's assets for their own personal gain and whose actions threatened both the future of the 'Call of Duty' franchise and the future of Activision's IW studio."<br />
<br />
Infinity Ward made last year's "Call of Duty: Modern Warfare 2," one of the industry's top selling games of all time. The IW studio was formed by West, Zampella and others, but Activision bought it in 2003 and signed the two to exclusive contracts.<br />
<br />
Activision paints a portrait of two disloyal employees who attempted to "steal" the Infinity Ward studio, even to the point of trying to block employees in the unit from obtaining bonuses or significant equity grants so they would have an easier time of poaching them once they were off on their own. Activision claims that they kept "millions of dollars of discrentionary compensation" for themselves instead of distributing it to other employees of the IW studio.<br />
<br />
Among other things, Activision's suit claims that West and Zampella held future editions of the "Call of Duty" franchise "hostage" unless Activision "acceded to their demands." The company also charged that they embarked on a "secret trip" by private jet to Northern California, arranged by their agent, to meet with executives with Activision's closest competitor, although that company was not named in the suit. It is believed to be Electronic Arts. The suit quotes from e-mail exchanges between the two, which Activision claims is proof that they were trying to "covertly copy certain materials" and "keep their actions hidden."<br />
<br />
Activision's suit seeks damages including back pay and certain equity stakes, as well as declarations prohibiting them from trying to poach company employees. They also seek an injunction preventing them from using company secrets to develop new games.<br />
<br />
West and Zampella's attorney, Robert Schwartz, called Activision's allegations "false and outrageous" and challenged the notion that they conspired to spin off Infinity Ward.<br />
<br />
